Booking Terms & Conditions

To make sure we offer a professional, simple and straight forward service we’ve got some terms and conditions of our sailing holidays, racing and mile building routes.

Terms and conditions for booking with Tangaroa Yacht Charters

  1. The contract
  2. Your contract is with Tangaroa Yacht Charters a trading name of Mescal Computer Solutions Limited.

    Submitting a completed booking and placing a deposit or full payment signifies your understanding and acceptance of the following terms and conditions:

  3. Bookings:
  4. Telephone, online or email bookings will be held for 3 days unless otherwise stated and agreed with us. The booking will be confirmed on receipt of a fully completed booking form and a deposit equal to 25% of the total cost of the holiday, crew space or mile building route. All bookings will be confirmed in writing by the issue of a booking confirmation and joining instructions either by post or email. Deposits are non re-fundable.

    The balance is due one month before sailing. In the event of non-payment we reserve the right to re-sell you holiday and/or crew space on a race or mile building route. The deposit will also be fortified – final reminders may not be sent and the client remains liable for the balance of fees.

    Bookings made one month before the holiday, race or mile build route commencement date must be accompanied by full payment.

  5. Under 18s
  6. Are more than welcome when sailing with a parent or guardian. However, if unaccompanied children between the age of 16 & 18 will be accepted if their booking forms are signed by their parent and guardian and this fact stated after the signature.

    Receipts will be only issued up-on request.

  7. Payment:
  8. All payments must be made by either:
    • Electronic bank transfer or;
    • Cheque
    Preferably these will be in either:
    • Pounds Sterling
    • Euros or;
    • Dollars

    Unfortunately we are unable to accept bookings made by Credit Card at this stage.

    Payment in Euros and Dollars will be subject to exchange rate fluctuations – this fluctuation may be in favour or against you. Tangaroa Yacht Charters cannot be held responsible for any fluctuation against your favour.

    Cheques should be made payable to Mescal Computer Solutions Limited and posted to Garden Flat, 26 Canonbury Street, London N1 2TD. it would be requested that cheques could be avoided and internet trnasfer used if possible

  9. Cancellations:
  10. A cancellation must be made in writing either by email or post and us deemed to take effect upon receipt.

    Cancellations made:
    • 1 month or more, prior to your sailing holiday, race or mile building route commencement date will result in the forfeiture of your deposit
    • Between 1 month to 7 days prior to your sailing holiday, race or mile building route commencement date will result in the forfeiture of 50% of funds paid
    • 7 days prior to your sailing holiday, race or mile building route commencement date will result in the forfeiture of 100% of funds paid

    If a client leaves the yacht and/or abandons a race or mile build route before the scheduled termination date and time for whatever reason, no refunds will be given and additional travel costs or other expenses incurred will not be reimbursed.

    If the cancellation is after the date of final payment (1 month before sailing) the client is liable to pay the outstanding balance, should we be unable to re-let your holiday and/or crew place on a race or mile build route. At the company’s discretion we may transfer the reservation to an acceptable alternative date.

    In the event of the company cancelling a holiday, race or mile build route we shall be liable only for full refund of fees paid. No payment will be paid for incidental costs.

    It is therefore strongly recommended that you take out travel insurance which will cover you should you need to cancel your booking.

    Cancellation by Tangaroa Yacht Charters:
    • No liability will be accepted by Tangaroa Yacht Charters if bad weather prevents the start of, or curtails a holiday, race or mile building route
    • In the event of the yacht being unable to return to port, or any other agreed final destination, on time, due to bad weather, engine breakdown or any other circumstances, clients may elect to stay with the yacht at no extra charge, or make their own arrangements to return at their own expense. No refunds will be given for unused flight tickets. If this is not covered by your travel insurance we strongly recommend you purchase scheduled flight tickets.

  11. Foreign Ports
  12. Please take your passport on any charter whether it is intended or not to visit a foreign port. A client must seek permission from the skipper for anything he/she brings onboard whilst in a foreign port . If a client is found to breach this rule, the person shall indemnify Tangaroa Yacht Charters and the Skipper against all legal action, impoundment and loos incurred as a result

  13. Skippers Decision
  14. The skippers decision is final at all times.
    • From the moment the skipper steps onboard, his/her decision is final at all times in accordance with maritime law
    • All clients and members of their party will accept orders and decisions given to them by the skipper at all times while onboard or ashore for the duration of the charter and the Skipper is no longer onboard the vessel. The skippers authority is total day and night in accordance with Marine Law
    • If for whatever reason, the client does not accept an order from the skipper or his designated substitute, whether the client considers it to be reasonable or not, the client shall be considered in breach of the Articles of sailing. The skipper shall take the action He/ She sees fit to ensure the safety and well being of the vessel and crew. If this involves putting the client or one of the members of his party immediately ashore Tangaroa Yacht Charters will not reimburse or in any way be held responsible for any costs incurred for travel or any other expenses.

  15. Sea Time
  16. We will endeavour to give the client maximum sea time. However, if in the skipper’s opinion weather conditions or safety considerations render it imprudent the skippers decision is final.

  17. Change Of Vessel:
  18. If the Company has to change the vessel because of some unforeseen circumstances this in no way affects the booking and the Terms and Conditions stated herein remain good.

  19. Damage or loss
  20. The company shall not accept claims and shall not be liable at any time for claims or expenses caused by circumstances beyond its control including:
    • Sickness;
    • Accident;
    • Travel delays;
    • Weather;
    • Strikes
    • War or;
    • Civil unrest

    The cost of making good any damage or loss of equipment resulting from the carelessness of the client or members of his/ her party will be to the account of the client.

  21. Insurance
  22. The yacht Tangaroa is fully insured against accident, third party liability and personal injury due to negligence by Tangaroa Yacht Charters.

    No liability is accepted by Tangaroa Yacht Charters for personal accident or loss or damage to the property of the client. The client must therefore arrange his/ her own personal insurance.

  23. Medical
  24. All client must agree to notify Tangaroa Yacht Charters of any medical conditions, illness or allergies suffered by themselves or any member of their group by signing a Health Declaration which we will send to you once a deposit has been received. If the client is in any doubt about his/ her fitness of the fitness of any of their group the relevant member of the party a GP must be consulted.

    Clients are recommended to obtain an European Health Insurance Card which will provide cover for medical treatment in all ECC countries. Further information can be found at http://www.e111.org.uk/apply.html

    We carry Stugeron onboard in the case of Seasickness. It should be checked with your doctor that these can be taken by the Client.

    In the interests of comfort and safety smoking is not permitted below deck. Clients can smoke in the cockpit provided they are mindful of where their smoke and ash are going so they do not cause discomfort to other crew members or damage to the yacht.

  25. Drugs & Alcohol
  26. No client or guest may bring onboard illegal drugs, substances, objects or contraband whatsoever. Any person found in possession of any of the aforementioned items will be put ashore immediately, regardless of location. Tangaroa Yacht Charters will not reimburse or in any way be held responsible for any costs incurred for travel or any other expenses. In addition, the person shall indemnify Tangaroa Yacht Charters and the Skipper against all legal action, impoundment and loos incurred as a result.

    While the boat is not underway alcohol may be consumed onboard in moderation. This is as long as the safety of the boat, as well as the safety and comfort of other persons onboard is not compromised. If someone is found to be affecting the safety of the yacht or comfort of other passengers thru their continued consumption they will be asked to leave the boat. This will be at the skipper’s discretion. Tangaroa Yacht Charters will not reimburse or in any way be held responsible for any costs incurred for travel or any other expenses.

  27. Photographs
  28. By placing a booking with Tangaroa Yacht Charters and accepting these terms and conditions the client and all members of their party agree to the use of any photographed or videoed images being used by Tangaroa Yacht Charters for promotional purposes.

  29. Dispute
  30. In the event of a dispute not being settled by mutual agreement an arbitrator shall be elected by the President of the British Law Society. It is further agreed all agreements between customers, clients and staff of the company shall be governed by British law, even when the dispute occurs outside British Territorial waters
